  美国移民政策不断收紧的情况下,移民排期变化如何呢?国务院这周公布了10月移民排期,不少职业移民恐怕都是心里一凉。尤其是EB2,一改去年底以来每月前进的势头,竟然大幅倒退了两年多。下面我们一起来看看美国国务院:2019年10月美国移民排期表出炉。

  不过对于EB1和EB3的中国大陆申请者来说,这个月的排期并不算是坏消息,这是因为,移民局本月罕见地开放了B表,至少到现在为止,移民局网站上还是这样写的(也不排除过几天又改回只能看表A,以前移民局就这样变卦过,所以如果您的表B排期到了,要抓紧时间递件):

  

  这样一来,EB1申请人可以用表B的日期2017年9月1日,比8月那次大倒退之前还前进了4个月;而EB3申请人的表B日期是2017年3月1日,几乎可说是史上最好的排期。

  EB2申请者本月成了最大的输家,但有律师分析,这可能是因为前几个月排期稳步前进,递交485表的人太多,移民局眼见又要忙不过来,所以刻意做了回调,预计未来几个月还是会渐渐恢复。不过由于取消职业移民绿卡国别限制的S386法案,中国大陆申请者都惶惶不安,难免心焦。

  至于亲属移民,10月有的类别表A排期出现停滞,但表B的情况还不错,而亲属移民排期是可以继续用表B的。

  This bulletin summarizes the availability of immigrant numbers during October for: “Final Action Dates” and “Dates for Filing Applications,” indicating when immigrant visa applicants should be notified to assemble and submit required documentation to the National Visa Center.

  Unless otherwise indicated on the U.S. Citizenship and Immigration Services (USCIS) website at, individuals seeking to file applications for adjustment of status with USCIS in the Department of Homeland Security must use the “Final Action Dates” charts below for determining when they can file such applications. When USCIS determines that there are more immigrant visas available for the fiscal year than there are known applicants for such visas, USCIS will state on its website that applicants may instead use the “Dates for Filing Visa Applications” charts in this Bulletin.

  1.  Procedures for determining dates. Consular officers are required to report to the Department of State documentarily qualified applicants for numerically limited visas; USCIS reports applicants for adjustment of status. Allocations in the charts below were made, to the extent possible, in chronological order of reported priority dates, for demand received by September 9th. If not all demand could be satisfied, the category or foreign state in which demand was excessive was deemed oversubscribed. The final action date for an oversubscribed category is the priority date of the first applicant who could not be reached within the numerical limits. If it becomes necessary during the monthly allocation process to retrogress a final action date, supplemental requests for numbers will be honored only if the priority date falls within the new final action date announced in this bulletin. If at any time an annual limit were reached, it would be necessary to immediately make the preference category “unavailable”, and no further requests for numbers would be honored.

Section 201 of the Immigration and Nationality Act (INA) sets an annual minimum family-sponsored preference limit of 226,000.  The worldwide level for annual employment-based preference immigrants is at least 140,000.  Section 202 prescribes that the per-country limit for preference immigrants is set at 7% of the total annual family-sponsored and employment-based preference limits, i.e., 25,620.  The dependent area limit is set at 2%, or 7,320.
